MusicRights Check is an educational tool. It helps you think through licensing risk, but it does not give legal advice, does not grant licenses, and does not certify that anything you are doing is compliant. You are responsible for your own decisions and for working with qualified legal and licensing professionals.
1. Nature of the Service
MusicRights Check is a web based tool that provides general informational guidance about common music licensing concepts and risk considerations for digital and in person use cases such as live streaming and public performances.
MusicRights Check:
- Does not provide legal advice.
- Does not determine or certify legal compliance.
- Does not grant licenses or permissions of any kind.
- Does not guarantee that any specific use will be permitted or will avoid enforcement.
2. No Legal Advice or Professional Relationship
You acknowledge and agree that MusicRights Check is not a law firm and that no attorney client, advisory, fiduciary, or professional relationship is created by your use of the service.
All outputs, reports, risk summaries, and explanations are for general informational and educational purposes only and must not be relied upon as legal advice. You are solely responsible for consulting qualified legal professionals about your specific situation.
3. Educational Use Only
All information provided by the service is generalized and non authoritative. Content may be incomplete, simplified, or out of date. The service does not represent or speak for any rights organization, publisher, platform, or other third party.
No output from the service should be interpreted as a statement that a particular use is permitted or licensed. Any licensing decisions you make are your own.
4. Your Responsibility and Decision Authority
You agree that you are solely responsible for:
- Verifying all rights and permissions needed for your specific use.
- Understanding and complying with applicable laws and regulations.
- Understanding and complying with platform policies and terms of use.
- Any communication with rights holders, publishers, PROs, or other organizations.
MusicRights Check does not control platform behavior, enforcement actions, or third party decisions and cannot prevent content takedowns or claims.
5. Assumption of Risk
You acknowledge that music licensing and enforcement are complex and can vary based on jurisdiction, contract terms, and fact specific details. You understand and accept that outcomes may differ from the educational guidance shown by the service.
By using MusicRights Check, you voluntarily assume all risks associated with your own licensing decisions, including the risk of claims, takedowns, or enforcement by third parties.
6. Limitation of Liability
To the maximum extent permitted by law, MusicRights Check and its owners, operators, and contributors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including without limitation loss of revenue, business interruption, or reputational harm, arising out of or relating to your use of the service.
To the maximum extent permitted by law, total aggregate liability for any claim relating to the service will not exceed the amount paid by you for access to the service in the twelve (12) months preceding the claim, or one hundred dollars (USD 100), whichever is less.
7. No Warranties
The service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory. Without limiting the foregoing, MusicRights Check disclaims any warranties of accuracy, completeness, fitness for a particular purpose, and non infringement.
8. Third Party References
Any references to platforms, PROs, publishers, licensors, or other organizations are provided for informational purposes only. They do not constitute endorsements, affiliations, or statements of authority and should not be interpreted as such.
9. Dispute Resolution, Arbitration, and Class Action Waiver
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the service will be resolved exclusively through binding individual arbitration. You agree that arbitration will be conducted on an individual basis only and not in any class, collective, or representative proceeding.
You waive any right to a jury trial or to participate in a class action or similar representative proceeding against MusicRights Check relating to the service or these Terms.
10. Governing Law
These Terms and any dispute arising out of or relating to them or the service will be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
11. Changes to These Terms
MusicRights Check may update these Terms from time to time. When updates are made, the “Last updated” date at the top of this page will be revised. Your continued use of the service after changes become effective will constitute your acceptance of the updated Terms.
12. Your Acceptance
By accessing or using MusicRights Check in any way, you affirm that you have read, understood, and agree to be bound by these Terms and any updates that apply at the time of use.
